Long Term Pain In Personal Injury Cases

Trauma patients in America's hospitals are not necessarily "all better" just because they are released from the hospital. A large number of those hurt in accidents and falls and are treated at hospitals are not pain free upon their release.

62.7% of patients in hospital admissions from trauma had pain 12 months llater. The pain was characterized as moderately severe. More than half of these patients had 3 painful areas or more.

The above findings come from a study of over 3,000 patients in 69 hopitals in 14 states in the U.S. (published in the Arch Surg. 2008;143(3):282-287.)

Pain is a factor in recovery from an injury. It is also an important component of a claim for damages in a personal injury case.

A car accident left occupants of two(2) vehicles injured last night in Lee county. The occupants were taken to the hospital after at least one vehicle left the roadway and crashed into a telephone pole.

Florida Motorists May Not See a Drop in Auto Insurance Rates

On October 1st, no-fault auto insurance expires in Florida and many drivers are hoping for lower auto insurance premiums. Insurers were promised an average savings of 13 to 16 percent in premiums.

Drivers will be required to purchase $10,000 in personal injury protection (PIP), to cover medical expenses for drivers and passengers following an accident. For some, especially those who do not have health insurance, higher premiums may await them in the future.

Opponents of the changes are concerned that the amount of lawsuits may increase. They also fear health insurance premiums may increase also.

Reviews by the Miami Herald, of several auto policies that come up for renewal next month, show an average savings of 10 percent or less. And that is if consumers don't buy medical coverage to replace the benefits of what is now provided by PIP.

Four Killed When Amtrak Train Strikes Car

Four people were killed, Monday, in a train vs. car accident at a railroad crossing when an Amtrak train struck a car, police said.

Witnesses say the car drove around the crossing gate. The impact of the crash threw the car in the air and the train came to rest approximately 300 yard down the train tracks.

The car was completely destroyed, police said. There were no reported injuries on the train.

The train was transporting 161 passengers from Miami to New York, an Amtrak spokesperson said.

The investigation is ongoing. It is not known how fast the train was going at the time of the crash.

Woman Arrested in Hit and Run Accident

Police have made an arrest in a hit and run accident that killed a man in a wheelchair.

The suspect, 32, is charged with leaving the scene of the accident with death and felony driving on a suspended license.

On Wednesday night, at 9:00 p.m., the man was crossing Fowler Street in his motorized wheelchair when a car hit him and sped away leaving the scene.

Police had been looking for a suspect but had turned up empty. Friday, homicide investigators received an anonymous tip that led them to the suspect. Officer's seized the vehicle and she later surrendered to police.

She told police she had panicked after the crash and fled the scene. She says she is remorseful and cooperative with the police.

Since 1999, she has been arrested:
â€¢ Five times for failing to obey a traffic device
â€¢ Three times for speeding
â€¢ Two times for driving an unsafe vehicle
â€¢ Four times for driving with a suspended license

Driver Hits Two Pedestrians on Beach, One Dead

A 24-year-old driver, suspected of driving under the influence of alcohol, struck two pedestrians in a car accident on Fort Myers Beach, Saturday, killing one, said Florida Highway Patrol.

The accident occurred just after 9:30 p.m. on Main Street.

FHP says the victims, a 55-year-old man and an unidentified woman were crossing the street when they were hit by a car. The impact caused the windshield to shatter. The woman died at the scene. The man was transported to Lee Memorial Hospital where he was listed in serious condition.

Charges are pending, said FHP. While investigators are saying the driver was under the influence of alcohol, it has yet to be determined if the victims had also been drinking prior to the accident.

3 Killed, 4 Injured In Head-On Collision

A woman and her two children were killed in a fatal car accident, Saturday, and four others were injured when an SUV crashed head-on into another vehicle south of Fort Myers, authorities said.

Florida Highway Patrol said the accident occurred at around 1 p.m. when the SUV was attempting to make pass in the left lane on Corkscrew Road, losing control of the vehicle and crashing head on into a car.

A woman, 37, and a boy, 9, both occupants of the SUV, were killed in the collision also killed was a passenger in the car, 12. Four other people were injured in the crash, two are in serious condition and two are listed in critical condition.

Troopers are unsure of how or why the SUV lost control. The accident is under investigation.

Driver Crashes into Side of House

A driver lost control of his vehicle, in a car accident, when he crashed into the side of a child's bedroom in Fort Myers, Florida. The accident left a huge hole in the side of the house located on Saint Ann's Court.

A neighbor was nearly run over in the accident but officials say that no one was home at the time of the accident. A neighbor heard some noise, turned around and saw the truck go through a ditch, his tree and bounced off a rock and continued on to crash into the house.

The driver was transported to the hospital but there is currently no information about his condition available.

Driver Transporting 11 Children, Cited for Accident

Fort Myers Police is investigating a day care worker that has been involved in a car accident on Wednesday with eleven children. None of the children had their seatbelts on, nor were they in car seats, say police.

Officials say the woman was driving her Dodge Durango on State Road 82 when she tried turning left onto Buckingham when she drove into the path of a van. The driver of the van was ejected from the vehicle. He was taken to the hospital and listed in critical condition.

The children, who varied in age from 6 months to 9 years old, were restrained in any fashion. Eight of the eleven children were transported to the hospital.

In the past, she has been caught driving on five separate occasions with children in her vehicle, while they were unrestrained.

Eleven Citations were issued to the daycare worker:

1 for violation of right of way

4 for seatbelt violations

6 no child restraint violations

"With the seatbelt tickets she's facing a hefty fine, but no jail time right now," said Officer Seay. Additional charges could be added pending the condition of the driver of the van.

3-year-old Injured in Hit and Run

Police are searching for the driver that ran over a three-year-old boy "twice" in a hit and run accident.

The driver of a white truck backed up over the boy and then rolled over him again, before taking off. The car was found blocks away from the accident, but the driver is still unknown.

The boy is in critical condition but authorities report he is expected to recover from his injuries. He was one of many children in the parking lot when the accident occurred, report witnesses of the accident.
